“They didn’t read my my rights”

I get this question alot. How come when I was arrested, the police didn’t read me my rights? Many people believe that the arrest itself requires the reading of your rights. This is not correct. The reading of your miranda rights is required when (1) you are in custody, meaning you’re not free to leave, and (2) the police are going to ask you questions. Unless both apply, the rights don’t need to be read.
